
The general terms and conditions (hereinafter referred to as GTC) of ACP (Action for persecuted Christians and the needy) apply to all orders, registrations and other concluded contracts with ACP made directly or via the websites of ACP.
The version of the GTCs valid at the time of the order or registration shall apply in each case. ACP reserves the right to change the GTCs.
2. Offer and Conclusion of Contract
The prices quoted are in Swiss Francs (CHF) and include value added tax. All offers are non-binding and do not represent any legal claim. ACP shall have the right to make changes to offers, product ranges and prices at any time without prior notice. The respective price at the time of the order or registration shall apply.
The order or registration of the customers is binding for them after receipt of the confirmation by e-mail.
ACP is free to reject orders or registrations in whole or in part without giving reasons. In this case, customers will be informed promptly and any payments already made will be refunded. Further claims are excluded.
Contracts are only concluded if and when ACP executes the orders of the customers or confirms the orders or registrations to the customers in writing (by e-mail or letter). Cancellations of events and assignments must be made by e-mail or telephone. Cancellation fees may apply for cancellations.
3. Shipment / Payment / Retention of title
For deliveries of goods, shipping is at the risk of the customer. Postage and packaging costs will be charged to the customer either as a lump sum or according to actual costs. If the payment method invoice is chosen, it is usually payable within 30 calendar days.
The shipment is usually within 3 to 4 working days. If items ordered by customers are not in stock, they will be delivered as soon as possible. In the event of a redelivery due to incorrect address information, the customer shall bear all shipping costs incurred. Shipments within Switzerland or the Principality of Liechtenstein will be invoiced in Swiss Francs. Shipments to the other neighboring countries of Switzerland will be invoiced in Euro.
The delivered goods shall remain the property of ACP until full payment of the invoice amount.
4. Defects, exchange and right of withdrawal
After receipt of the ordered goods, these are to be checked immediately for defects. Transport damages, wrong deliveries and other defects can be reported within ten days after receipt of the goods in writing to mail@acp-uk.org or by telephone on +41 (0)32 356 00 80. ACP may choose to replace the warranty with an equivalent product or refund the purchase price. Exchange or cancellation of orders are only possible in case of defective or faulty goods.
5. Data protection
The protection of personal customer data is important to ACP. More detailed information on the handling of personal data is set out in ACP's Privacy Policy. The data protection regulations are an integral part of this GTC. If the customers agree with the GTC, they also automatically agree with the ACP's Privacy Policy.
6. Donations
Donations will be used according to the purpose of the donation. This applies to cash donations, donations by bank transfer or by means of gift cards from the online store.
Exceptionally, it may happen that more funds are received for a project than are needed, or that a project is completed before the donations are received. Such funds will subsequently be used for another project with as similar a goal as possible. Donations marked where most needed or available for discretionary use will help ACP fund projects that are not adequately covered by earmarked donations.
7. Disclaimer
ACP disclaims liability to the fullest extent permitted by law for all direct or indirect damages resulting from goods purchased, visits to ACP websites, third party websites linked to ACP, participation in ACP events or operations, or other contractual transactions. In particular, ACP excludes liability for slight and moderate negligence. Also, ACP does not assume any contractual or non-contractual liability for damages caused by auxiliary persons engaged for the provision of services.
8. Further provisions
The legal relationships are subject to Swiss law. The exclusive place of jurisdiction for all disputes is Biel (BE).
Should individual provisions of the GTCs be or become invalid or ineffective, the validity of the remaining provisions of the GTCs as a whole shall remain unaffected. Invalid or missing provisions shall be replaced by the dispositive law.
9. Entry into force
hese GTCs come into force on 01.01.2022. They replace all GTCs of ACP valid until this date.
